More Australian parents defy law with overseas surrogacy

A sharp rise in Australian children born in India shows laws criminalising commercial surrogacy are doing nothing to stop parents going overseas to find birth mothers for their children, surrogacy advocates say.
The number of citizenship requests for children born in India has risen by more than 300 per cent over the past five years, documents obtained under freedom of information show.
Surrogacy Australia founder Sam Everingham said Australians were fast becoming the highest per capita users of compensated, or commercial, surrogacy, despite laws in NSW and other states criminalising it, even if it occurs overseas.
"Australia, funnily enough, has become one of the largest surrogacy markets internationally because of the perfect storm created by the lack of access to international adoption, women leaving childbirth later on and the fact we are a wealthy country and women can afford it," he said.
Mr Everingham estimated that about 100 NSW couples each year were engaging in compensated surrogacy overseas, and about 500 nationally.
Since March 2011 NSW parents who do so have risked two years' imprisonment and fines of $275,000.
Nationally, the Family Law Council is reviewing how best to deal with the legal issues posed by increasing use of surrogacy, with a report due in December.

A gift of life: Surrogate motherhood is a way of life for LaDonna Woodmanssee

OB-GYN Andrea Miller had a unique opportunity in 2011 — to deliver her own baby. That's because Miller's baby was being born to a surrogate mother, LaDonna Woodmansee, who carried the Miller's baby for nine months.
Instead, Miller chose stand on the sidelines of the birth experience while a close colleague delivered little Addison Miller in August of 2011. The moment the baby was born, she was swaddled and placed into the waiting arms of her mother, Andrea Miller.
There wasn't a dry eye in the delivery room as the Millers finally saw their baby. The tears were also in gratitude to Woodmansee for making the couple's dream of parenthood a reality.
“She's the real star of this story,” Steve Miller said. Woodmansee has also been a star for two other families for whom she served as a surrogate.

Laws concerning surrogacy
Woodmansee said that at age 36, she might consider one last surrogacy, but knows that any more than that could be too hard on her body. But she said if the Millers do decide to give Addison a sister or brother, she hopes to carry the baby.
“Besides having my own kids, surrogacy is the best thing I've ever done,” she said. It's not about money — in Oklahoma, laws are vague on surrogacy.

Nancy Juvonen Fallon and Jimmy Fallon Reveal Surrogate Baby Secret (VIDEO)

Jimmy Fallon
Actor Jimmy Fallon poses at the 38th International Emmy Awards in New York City November 22, 2010

Nancy Juvonen Fallon and Jimmy Fallon have come out to reveal their secret that they used a surrogate to conceive their newborn baby.

The 38 year old late night TV host and his 46 year old wife have had difficulty trying to conceive, Jimmy Fallon revealed on the Today show this week, and that was their reason to use surrogacy.
However, he also explained how the couple decided to keep the surrogacy a complete secret, even from close friends and family. That meant that when daughter, Winnie Rose Fallon, was finally born then they had to be careful with how they announced her sudden arrival and not hurt any close friends' feelings.
However, they also had a little fun with how they told the world the news. A rep for Fallon said in July that they were overjoyed at being first-time parents and the "arrival of their beautiful daughter," however, the rep did not note that Nancy Juvonen Fallon did not carry Winnie.

A most precious gift - Surrogacy is an option

SALynMateah10726col.jpg

If there is a cosmic scale that weighs the value of gifts, it has tipped mightily in Kristin Crossman’s favour.
Kristin has given her life-long friend, Chantal Kahovec, an irreplaceable, life-changing gift that few would consider.
About 10 years ago, Chantal was diagnosed with a cancer that left her unable to have a baby. She and her spouse John went through a procedure to have embryos frozen, in hopes of having a child through a surrogate mother. A cousin offered, but tragedy struck. Before the baby was born, the Kahovecs were told he was sick. Shortly after he was born, he died.

Their Baby: Story of a Surrogate via Weecare surrogacy USA

Baby feet

Rebecca, a former South East resident, has made the choice to become a surrogate mother. It's a decision she said came easily after a family member underwent a serious operation.
"I was thirteen and my sister had to have one of her ovaries removed. She had a cyst and since then, she was told she may have trouble getting pregnant herself...I knew at the time that if she couldn't... I would step up and act as a surrogate for her.
"It's always been something in the back of my mind...one day that I would do for somebody."
A mother of two already, Rebecca said her own pregnancies were uncomplicated and she felt she could help another couple unable to conceive naturally.
At first she didn't tell her husband but after her second child Taylor was born, she started to explore the possibility of becoming a surrogate further.
"Seeing my two kids and feeling as much love for them as I do, I couldn't imagine someone not being able to have that for themselves," she said.
Surrogacy service

The legal aspects of surrogacy
Rebecca said although commercial surrogacy was illegal in Australia, the intended parents would pay for her medical and legal costs, including small things such as travel to doctor's appointments and anti-nausea medication.
She said the most difficult part, once undergoing rigorous counselling was the legal minefield.
Even things such as who would hold the baby first in the delivery room were all written in a legal document and signed by both parents.
"We know when that baby is born, she will hold the baby first.
"That's what keeps you going through all the hours of counselling and paperwork...we're both looking very much forward to that moment now."

No Indian surrogate if you’re gay, unmarried or single via @ @ Weecare surrogacy

If you are a gay couple or a single man/woman looking for a surrogate then India’s no longer the place for you. A new Home Ministry directive has sought to put in place stringent rules regarding medical visas given to foreigners. The diktat says that only a man-woman couple who have been married for over two years will be granted medical visas for surrogacy. Furthermore, foreign couples who want to adopt will have to furnish documents from their parent country’s ministry or embassy to prove that they recognise surrogacy parenthood and the letter also needs to contain assurances that the child born to the Indian surrogate mother would be allowed to enter their country and enjoy the same liberties as a biological child

Surrogacy news - A Sister's Gift: Aggie Student Births Sister's Baby

From the time she was a little girl, Katie Andrews of Bryan dreamed of being a mother. But when she was just 15, she found out that she would never carry a child. Katie was born without a uterus.
"I knew that I could have a biological child. I just couldn't carry it," Katie said.
When she and Jarod married in 2007, they knew they would have to use a surrogate to have a child, but they never imagined who would offer to carry the baby Katie could not.
"Courtney came to us and said that she would like to do this for us," Katie recalled.
Courtney Guest is Katie's little sister. Just a sophomore at Texas A&M University, Courtney told her mom, Susan Guest, that she wanted to help her older sister.
"I just patted her on the head and said, 'Darling, that's really sweet, but you can't do that,'" Susan said.
"At first, I told her no because she was 19 at the time," Katie added. "We said, 'That's so sweet -- that's such a sweet offer for you to do that for us.'"
But Courtney was determined to help her sister. She even went to the doctor on her own to be cleared for surrogacy.
"I have this young, healthy body that can carry a child. Why should I keep it to myself when I can do this great thing for her," Courtney explained.

Surrogacy news - Province to review rules involving surrogate couples

John Woods / Winnipeg Free Press
Mike Olson, with his wife, Lisa Seel, holds their son, Keenan.
THE minister responsible for Manitoba's Vital Statistics Agency says he will investigate whether rules and procedures can be changed to avoid the frustration suffered by a city couple whose names weren't listed on the certificates of their twin sons' births.
"We're going to continue to look at what is happening in other jurisdictions and see what we can do to help make it easier for couples in this situation," Jim Rondeau said Tuesday.
Rondeau was responding to the story of Mike Olson and Lisa Seel, parents of twin boys born Dec. 24. The babies were carried to term by Seel's sister, Averill Stephenson, following embryo transplants.
The couple got legal advice on how to proceed with the surrogacy, but were unprepared for how Vital Statistics would record their sons' births. Stephenson was listed as the mother on the birth certificates, and since she is legally married, her husband was automatically listed as the dad. Olson and Seel now have to go to court to have the birth certificates reflect the reality they are, in fact, the parents.
But both Rondeau and the director of Vital Statistics, Susan Boulter, said Tuesday the couple's lawyers should have warned them they would have to apply to the courts to make the changes.

Foreign gay couples can't have surrogate babies in India, says Home Ministry directive

Representational photo

Foreign couples in live-in relationships, same-sex couples and singles will not be able to have surrogate babies in India anymore.

A Home Ministry directive on surrogacy is badly affecting foreigners seeking to become parents in India through surrogacy. The Home Ministry has asked the External Affairs Ministry to issue visas only to opposite sex couples seeking to have a surrogate baby in the country. The ministry has further said such couples should be married for at least two years.

Though there is no law on surrogacy in India, the Indian Council of Medical Research has drafted Assisted Reproductive Technology (Regulation) Act, 2010 which deals with the issue. According to the Bill, assisted reproductive technology will be available to all persons, including single persons, married couples and unmarried couples, a member of the drafting committee said.

Vietnam considers legalizing surrogacy for humanitarian purposes Via Weecaresurrogacy USA

Vietnam’s Ministry of Justice is considering legalizing surrogacy among other proposed changes to the country’s 13-year-old Family and Marriage Law.
Duong Dinh Hue, head of the civil and economic desk at the ministry, said at a Tuesday meeting that the ministry aims to amend the law in a “fundamental and comprehensive” way, Tuoi Tre reported.
Tuong Duy Luong, vice presiding judge of the Supreme People’s Court, said surrogacy is not a simply a legal issue, but a sensitive social concern.
Luong said the country should recognize the service for humanitarian purposes, as there are many women who are unable to become pregnant due to medical reasons. “They are the disadvantaged. It’s inhuman if we do not support them.”

Surrogacy India - Baby boom: Indian women giving birth to U.S. babies

A lot of businesses go to India for inexpensive labor and it turns out American couples are doing the same. One village has become a center for cut-rate surrogacy, offering young women who will be carrying babies to term.

For some couples surrogacy is their only chance to create a child. Each year hundreds of Americans go to India for the service.
Dana and Sumanth Chandra have been trying to have a baby ever since they married 14 years ago in Chicago.
They believe their newborn son Ethan is a miracle -- because doctors in the United States told Dana she'd never have a child.
"I could just spend my entire life just standing right here," she says while looking at her baby son.
The couple finally realized their dream of starting a family by traveling 8000 miles to India -- the country where Sumanth grew up.
Ethan was born to a surrogate mother at a clinic in the dusty town of Anand -- a hub in India's multimillion dollar surrogacy industry.
An embryo created from the Chandra's own sperm and egg was implanted in an Indian woman -- who was paid to carry their child.

Surrogacy India - Our Surrogacy Adventure in Mumbai

Our Surrogacy Adventure in Mumbai

Two Guys from San Diego on their way to Parenthood

I will try to open the first act of our blog by introducing ourselves with a few words. We are a gay couple from San Diego, and we are on our way to fulfilling one of our dreams: becoming parents. After a few ups and downs, we came to the conclusion that Surrogacy would be our best option and, after a few more ups and downs, we decided that we would hire WeeCare Partners USA to fulfill our dream.

We are now 18 weeks pregnant.

Surrogacy in India is not for the faint of heart. Like all the people who are currently going through the same experience, we have had our fair share of stress, but we have met wonderful people along the way...

First of all, we have met another San Diego gay couple who just had two baby boys. They gave us valuable advice and connected us to Victor Hui Wee’s agency (WeeCare Partners USA, service agency for India Surrogacy). Victor has basically enabled our dream, connecting us with more wonderful people, such as Dr. Meenakshi Puranik who is supervising the whole process. We are very thankful to have met such an amazing and talented woman. We also have to thank our egg donation agency and our egg donor, who has been wonderful and charming. We would also like to mention our driver, Sachin, who has guided us through the chaos of Mumbai’s traffic.

Bundle of Joy: The Costs of Adoption vs. Surrogacy

From Brangelina's burgeoning adopted brood to Giuliana Rancic's baby mama, the glitterati have made alternative ways of bringing home baby look easy. But it's only easier if you have those box-office millions in your bank account.
The reality, of course, is more complicated and expensive. Hopeful couples discover that adoption or gestational surrogacy costs from tens of thousands of dollars to more than $100,000. (And that's on top of the thousands of dollars many have already shelled out on fertility treatments, to say nothing about the emotional toll.)
Financing options are available -- from grants to loans to companies willing to foot part of the bill -- but these are few and far between and usually don't make up the entire cost of adding a child to a family.
Here is a breakdown of the costs of surrogacy and adoption while explaining the financing that might be available for those couples who have difficulty having their own children naturally.

Surrogacy in Thailand is for Same sex and single.

Welcome Future families, we are glad you are considering Weecare surrogacy as you explore options to expand your family. Weecare and our partners have a long and proud tradition of working with lesbian, gay, bisexual, transgender and single parent in their quest to become parent, and every year our numbers grow stronger. We have met the reproductive needs of our clients with compassionate, patient-care. Our mission is to ensure each client is comfortable and confident throughout their surrogacy journey.
As a gay, lesbian, bi-sexual, transgender or single parent individual, you experience the same concerns as those in any other relationship. You wonder what the future holds and whether you will be able to fulfill your wish to have children and accomplish your dreams of building a family.
This can be overwhelming, but in today's age it is easier than ever for both you and your partner to experience a pregnancy and become parents -- as opportunities for couples or single to start a family are unprecedented.
At Weecare, along with experts in childhood development, agree that a loving and supportive family is the most important ingredient when it comes to good parenting. Research has demonstrated that sexual orientation; gender identity or expression does not affect a person’s ability to parent.
WeeCare Partners for Thailand Surrogacy also believes everyone has the right to experience the love of a child and the joy of becoming a parent, and does not discriminate against age, race, marital status, religious affiliation, or sexual orientation. Without a doubt, though it is thrilling and ultimately fulfilling, even thinking about the process of surrogacy can be overwhelming. This is where we can help.
Egg Donors for Same Sex Couples
Donor Egg is a very successful option for building a family because it has higher success rates than IVF cycles using a woman’s own eggs. The primary reason is that the eggs are collected from young donors who are carefully screened to assure safe and successful treatement. For gay men, family building through IVF requires the use of an egg donor and a gestational surrogate. Building a family via Donor Egg allows for strong biological and developmental relationships -- as donor eggs are fertilized with the male partner’s sperm, matured to an early embryonic stage and then placed in the surrogate mother uterus, providing her the same gestational experience as natural conception.

Should commercial surrogacy be made legal in Britain?

As far as gifts go, it’s a pretty special one. A baby.
More and more heterosexual and same-sex couples in Britain are turning to surrogate mothers to help them have a family.
This month, singer Sir Elton John and his civil partner, film producer David Furnish, welcomed their second son into the world.
Both children were born to the same surrogate mother through an agency in California, where commercial surrogacy is legal and surrogates can be paid.
While surrogacy is legal in Britain, it is a criminal offence to pay a surrogate mother more than ‘reasonable expenses’ and it is also illegal to advertise that you are seeking a surrogate mother or willing to act as one.

Gay surrogacy ban 'breaches rights'

BANNING gay couples from accessing surrogacy services in Queensland breaches universal human rights provisions, a lawyer says.
The Queensland government plans to make it illegal for gay couples and single people to use surrogates to have children in a move backed by Christian and conservative groups.
However surrogacy specialist Stephen Page of Harrington Family Lawyers told ABC Radio the changes would breach the UN's Universal Declaration of Human Rights and the federal Sex Discrimination Act.
"If anything, these children are going to be cherished," he said.
"They're going to be loved and the people that I've seen who've had their children through surrogacy, they love their kids to bits and it makes no difference about whether they're a couple or they're single, it makes no difference about their sexuality.
