Debate over paid surrogacy begins again

SEATTLE -- A battle could once again be brewing in Washington state over the issue of paid surrogacy.

Surrogacy is allowed in Washington, but a woman cannot be paid for it. At least one state lawmaker wants to change that, and he's already hearing from the opposition.

Joseph Backholm of the Family Police Institute adamantly opposes paid surrogacy. He believes a paid surrogacy bill will be introduced during next year's legislative session, and he's speaking out now to ensure it doesn't pass.

"The idea that a parental rights to a child would be purchased with money under a contract is something that would not be good public policy," Backholm said.

Among other issues, Backholm said paid surrogacy sets a bad precedent and could result in custody disputes.

JENISON, Mich. (WZZM)- A West Michigan couple desperate for children of their own lose a legal battle and the twins they hoped to raise as their own.
Many couples who have trouble conceiving turn to other options, like a surrogate mother, to carry the baby.
That's what one Jenison couple chose to do, but instead of ending in joy it ended in heartache, in part because Michigan has one of the strictest surrogacy laws that prohibits contracts and favors the surrogate mother who can chose to take back the baby at any time.
Scott and Amy Kehoe can't help but smile when they talk about their twins. "Ethan was just a jabber and then Bridget was demanding. When she screamed she wanted her way. When she was hungry, she let us know it."

Chief Federal Court Magistrate John Pascoe’s call for amending Australian state legislation to allow commercial surrogacy, subject to statutory controls, has much to commend it.
The aim of the legislation would be “to stop the exploitation of poor women and protect the legal status of children caught up in the booming overseas surrogacy trade” according to today’s Fairfax papers.

Prohibition and protection

It’s often said that the only way to protect “vulnerable” people is by legally prohibiting conduct in which they may be exploited, with criminal penalties for those who engage in such activity. Historically, that has been the case in Victoria with many procedures related to assisted reproductive treatment (ART), such as commercial surrogacy, being criminal offences.
But experience has shown that strict prohibitions are often not effective in activities related to reproduction, especially when they can be lawfully undertaken in other countries. Sisters serve as surrogates for another sister

CINCINNATI - There's an unexplainable bond between sisters, and you know this if you are lucky enough to have one. When your sisters are hurting, you feel their pain. And some sisters will do just about anything to help that pain go away.
At age 28, Tanya Ratcliff had just found out that it wasn't likely that she would be able to have a baby.
"I was sitting in the car crying with my two sisters," she said.
Ratcliff has three sisters and a brother and has always wanted children.
"I come from a big family, my husband comes from a big family. I always wanted to have four kids," said Ratcliff.

This wasn't the first time in Ratcliff's life that she received bad news from a doctor.

"When I was 16, my mom was diagnosed with ovarian cancer," said Ratcliff.

After a five-year battle, her mother passed away when she was in college. A couple years later, Ratcliff met Dan and they got engaged. This was almost perfect because he wanted a big family too, but then came more bad news.

Ms Close gave birth to twins in July and in August Mr McMurrey revealed that he was gay and sued for custody. He claims that Ms Close was just a surrogate, not the biological mother and has no rights over the children. The twins now live with him and his boyfriend Phong Nguyen. Supervised by a camera, Ms Close gets to see the children for two hours a day on weekdays and four hours on Sunday, but she is not allowed to breastfeed them..

Gay dads now get paid parental leave

Gay fathers will now be eligible for paid parental leave, giving them the same rights as heterosexual parents when they have their baby.
Here in Australia same sex couples are still waiting to have their union recognized on par to heterosexual couples; but when it comes to parenting, equality is on the move.
On June 27th the Paid Parental Leave and Other Legislation Amendment (Dad and Partner Pay and Other Measures) Bill 2012 was passed, giving fathers of any sexuality paid parental leave when their baby arrives, allowing dad and the baby to strengthen the parental bonds early on. Senators OK fertility help for wounded vets - including surrogacy as a covered medical treatment

A Senate committee has approved providing fertility counseling and treatment, as well as adoption benefits, to veterans with traumatic injuries that affect their reproductive organs.
The landmark policy change would cover artificial insemination and, if necessary, surrogacy so that service-connected wounds are not a barrier to having a family.
Benefits are aimed at the 1,800 Iraq and Afghanistan veterans who have suffered spinal cord injuries or devastating wounds, mostly from improvised explosive devices, to their reproductive organs.
Fertility treatments are included in S 3313, the Women Veterans and Other Health Care Improvement Act of 2012, passed by the Senate Veterans’ Affairs Committee on Sept. 12 by voice vote after extended debate over whether surrogacy should be covered.
Sen. Patty Murray, D-Wash., the veterans’ committee chairwoman and chief sponsor of the bill, said including surrogacy as a covered medical treatment is the only way to ensure that a woman who suffers severe wounds to her reproductive organs would have benefits equal to a male veteran. “We cannot treat one veteran better than the next,” she said.

A 61-year-old woman, who gave birth to her daughter's baby boy, has told of her remarkable journey as a surrogate grandmother.
Kristine Casey, from Chicago, was a gestational carrier for her daughter, Sara Connell, and her husband Bill, who suffered heartbreaking infertility struggles. She successfully delivered their son Finnean in February last year.
Now, the family's unconventional journey has been told in Mrs Connell's new memoir, Bringing in Finn: An Extraordinary Surrogacy Story.
The book relates how the Connells decided in 2004 to try to have a baby, but Mrs Connell, now 36, soon discovered she wasn't ovulating.
After undergoing infertility treatment at the Reproductive Medicine Institute in Evanston, she became pregnant but delivered stillborn twins, and later suffered a miscarriage.

Mrs Connell's mother, who went through her own pregnancies without incident, was the hope the family needed. They came up with a unique plan, leading to Finnean Lee Connell's birth early last year.
In her honest memoir, Mrs Connell recounts the tragedy and heartbreak of losing pregnancies; how she opened up to the idea of her own mother carrying her child; and the bond between mother and daughter that blossomed as a result of their unique experience together.

That quandary has prompted the man, Manhattan Criminal Court Judge Robert M. Mandelbaum, to contest the will in surrogate's court.

Mandelbaum has filed a petition on behalf of his now 2-year-old son, Cooper, that argues that a condition that might "induce the beneficiary to enter into a sham marriage of convenience" should be invalid.

The petition makes two further arguments: that Mandelbaum's partner could be considered the boy's "mother," and that excluding the boy from sharing in the family fortune would run counter to public policies protecting same-sex marriages and their offspring.

Battle Lake woman answers sister’s prayers by carrying her child through surrogacy

ANDOVER, Minn. – On a quiet family camping trip along Minnesota’s Rum River, surrogacy might seem like odd topic to come up.

Five years later, sisters Kari Thorp of Andover and Tara Bladow of Battle Lake, Minn., can’t seem to remember who even brought the idea up. But without a second thought, two sisters pressed forward through a miraculous journey some might call the most beautiful gift a sister could give.

Christie vetoes ‘gestational surrogacy’ bill, arguing for more study

Governor Christie on Wednesday vetoed a bill that would have allowed residents to contract with — and pay — women to carry a donated embryo to term, saying such “profound change in the traditional beginnings of a family” needed more legislative study — an assertion criticized by the bill’s Democrat sponsors.
“Permitting adults to contract with others regarding a child in such a manner unquestionably raises serious and significant issues,” Christie said. “I am not satisfied that these questions have been sufficiently studied by the Legislature at this time.”
But Assemblywoman Valerie Vainieri Huttle, D-Bergen, one of the bill’s sponsors, said she was disappointed the governor “punted.”
The bill, she said, would have prevented surrogacy from becoming a legal battleground because it would have defined the rights and responsibilities of all parties involved to ensure that such an arrangement is not entered into without great consideration.

New legislation or the amendment of existing legislation was necessary to ensure mothers of surrogate babies could take maternity leave from work and receive child benefit payments, the Equality Authority has said.
Issuing its last annual report, before being merged with the Human Rights Commission, the authority highlighted the issue of the non-recognition in law of mothers of babies born to a surrogate mother.
Angela Kerins, chairwoman of the authority said it had supported three women who, though biologically the mother of their babies, were not entitled to maternity leave because they had not given birth to their babies.
“It’s terribly unfair that you have this newborn baby, that is your baby, and you can’t take maternity leave. I think the vast majority of Irish people would not want a situation like that to exist.”

Women who go through menopause before age 46 are twice as likely to have a heart attack or stroke as women who hit menopause later, according to a new study.
"These are women who should keep in mind that they are at increased risk," said Dr. Melissa Wellons, the lead author of the study from the University of Alabama at Birmingham.
"My advice to them would be to get your traditional risk factors checked... and do the things that we know, based on evidence, can improve your risk of developing heart disease, like keep your cholesterol in check and keep your blood pressure in check," she told Reuters Health.

Gestational carrier bill gets to Christie Via @ Weecare Surrogacy USA

A law allowing women to carry donated eggs to term for infertile clients is now before Governor Christie.
"Gestational carriers," meaning women who agree to receive a fertilized embryo that is not her own and carry the child, currently operate legally in other states but advocates say such agreements are not legally enforceable in New Jersey.
A bill that passed the state Assembly Thursday would legalize those contracts. In return, arrangements between willing participants could be all-expenses-paid - covering carriers' full medical bills as well as housing, food and living expenses for the pregnancy.
Assemblywoman Valerie Vainieri Huttle, D-Englewood, sponsored the legislation, which passed with the 41 minimum required votes.
Opponents argue the change allows surrogacy - an issue that has been controversial in New Jersey since the state's highest court ruled that the mother of Baby M, a paid surrogate who changed her mind about giving up the baby, had not given up her maternal rights to the child.

Straight, Single Men, Wanting Kids, Turn to Surrogacy

At a lavish baby shower outside of Boston, there was no pregnant mom in sight. The diaper genie and burp cloths were for a 45-year-old middle school principal named Peter Gordon.
Gordon has been dating and searching for Ms. Right for more than two decades, but hasn't found a wife. Yet, he badly wanted to start a family.
"I'm still hopeful," he said. "Some people are lucky in love. I haven't found luck yet. It's not for lack of trying."
Steven Harris, a 57-year-old lawyer from New York, found himself in the same predicament. He knew he wanted kids but didn't have someone to have them with and said he felt a "profound sadness" about 15 years ago.
"I really felt like I really was missing something," he said.
So Gordon and Harris, both heterosexual bachelors, made the decision to become dads on their own through surrogacy, using their sperm and a donor egg.
Gordon said he tried adoption before surrogacy but kept getting turned away.
"I called five different agencies and every one of them told me that either I would not be considered or that I would be at the bottom of the list because I was a single father," he said.

Newborn connects two continents

AUSTIN (KXAN) - A Pflugerville mother of four is the surrogate mom for a couple she's never met who live 10,000 miles away.

What do you do if you cannot conceive or perhaps carry a child through pregnancy? One option is adoption, but if you want your own blood kin, a surrogate mom may be the answer.

In western Australia, Jenny and Steve Suleski lost their third child during pregnancy, and Jenny was told she could not carry another.

By destiny or luck, the couple had a fertilized embryo in storage. Because of Australia's stringent surrogate laws, they looked abroad. Through an agency their search led them to a Pflugerville woman named Christi.

"We did a lot of research, America's a really good place to go for surrogacy," said Jenny Suleski. "Christi was in Texas, and Texas is great for us because the laws are very friendly."

Do maternity benefits apply in surrogacy case?

A reader writes: I am having a baby by a surrogate. Am I entitled to maternity leave and the related benefits?

Linda Stewart, partner and head of employment at Simpson Millar law firm, says:
As the law stands, unfortunately the answer is no. Entitlement to either maternity leave or statutory maternity pay does not extend to people who have a baby through a surrogate – these benefits are available exclusively to employees who give birth.

However, there is a growing wave of people who believe that the law on surrogacy is in urgent need of reform, especially as mothers whose babies are born through surrogacy require just as much support as birth mothers do. What’s more, both leave and pay are available to qualifying adoptive parents.
If, after the birth, you plan to adopt the baby through an approved adoption agency then you might be entitled to adoption leave and pay. In order to qualify you must have worked for your employer for at least six months by the end of the week in which you are notified by the adoption agency that the child will be placed with you. Adoption leave can be taken for up to 52 weeks and adoption pay is available for 39 weeks – some employers allow more.

More Couples Using Surrogates To Start Families

CASTLE ROCK -- Sex and the City star Sarah Jessica Parker did it. Now E! News anchor Giuliana Rancic and her husband Bill are the latest Hollywood couple to use a surrogate mom to expand their family.

Their public journey is opening doors for other couples in need and moms who want to help them. Moms like Kendra Landrey.

"It was always in my heart to do it," said Kendra, a mother from Castle Rock. "I told my husband if somebody ever needed my uterus, I'm game."

 Kendra is a mother of four. With three boys, a girl, and two dogs, the Landrey's already have their hands full. But her husband Arthur Landrey knows Kendra has always wanted to help other women.

"Of course it was okay. It's something she's always wanted to do and I wasn't going to get in the way of that," said Arthur.

BUNDABERG mother-of-two Melissah Smith knows the joys of being a parent, but she knows many others will never get that chance.
That is why when she gives birth to a baby girl on Thursday, she will hand her over to a New South Wales husband and wife who are unable to conceive their own child.

Mrs Smith is a surrogate, a woman who has given up more than a year of her life to go through testing, psychiatric assessments, nine months of pregnancy and finally birth, all so two strangers can have a family.

"My auntie could never have kids and did IVF in the 80s, but she still never fell pregnant, so it was something I always wanted to do," she said.

Mrs Smith first came into contact with the intended parents last year after leaving her name with a law firm in Brisbane. Months later, after plenty of tests and consideration, she became pregnant using the couple's egg and sperm.

"I had never met them before all this started, but now we speak nearly every day," she said.

"The first time I met them, it was like I already knew them - I think we were meant to meet each other."
Mrs Smith, who has two boys aged 11 and six, said under the Surrogacy Act, she could at any time choose to keep the child.

"Even though it's all their DNA and they have spent tens of thousands of dollars, I could just turn around and say, 'I'm keeping this baby'," she said.

When presidential hopeful Mitt Romney's eldest son, Tagg Romney, 42, and his wife, Jen, 39, posted a birth announcement for healthy, happy twin boys on their Facebook page, they demonstrated how mainstream in-vitro fertilization births have become. They gave "a special thanks to our gestational surrogate who made this possible for us."

The couple has six children; Politico reports that, though there was no surrogate involved in the older three children's births, the couple used the same surrogate for a now-2-year-old son.

E! anchor Giuliana Rancic just announced that, after years of trying to have a child, she and her husband are expecting - thanks to a gestational surrogate. Kathleen Sloan of the National Organization for Women complains that when mainstream media cover surrogacy births, "It's always from the angle of the miracle of life and not the use of some other women's eggs or the rental of another women's womb. Steps star Ian 'H' Watkins reveals surrogate baby miscarriage

 Ian 'H' Watkins has revealed that his surrogate baby has been miscarried.

The Steps singer said that the surrogate mother had lost the child that he and partner Craig Ryder were going to raise.

He described hearing the news as the "worst moment" of his life.

Misty Baker is still weeks from giving birth, but this Mother's Dayis going to be one to remember. She turned to a surrogate after battling with infertility for a decade, and now Baker and her surrogate are both pregnant with twins.

In other words, Baker and her husband, Brian, both 35, are going from zero babies to four babies overnight.

The unexpected turn of events has made headlines around the globe, with many people shaking their heads and asking whether the Kirkland, Wash., couple got more than they asked for.

"When I tell people, they say, 'Are you freaked out?' They are just flabbergasted," Brian Baker said.

But the couple could not be happier.

"When it's taken you 10 years to get what you have longed for and desired for so long, it's an overwhelming feeling of thankfulness and joy," Misty said.

And they feel especially blessed to have a special friend like Amber Pluckebaum as their surrogate. Without her, Misty said, none of this would be possible.

But before we get to Amber, let's go back to the beginning. Misty and Brian met through their church in Indiana when they were still in high school and started dating their senior year. Wannabe Grandparents Are Freezing Their Kids' Eggs

In the glut of books and articles about single women waiting "too long" to "settle," or the collections of stats about how adults are getting married later and later, if at all, there is that one hard-stop, that one thing that often ends up answering the awful question of how old is "too old." That is, to make babies. Women have only so much time, those biological clocks are ticking, all of that stuff you've likely heard if you're in your 20s or 30s or 40s and are still dating and figuring out what you want. It's not untrue that at some point, women will have aged past the point of having babies, or at least, having babies easily. (Yet some still do: Take New York's ASME-award winning cover and related story, which asks, "Is there anything wrong with being 53 and pregnant?"). It's a topic we'll continue to discuss as technology helps women (and men) have children later in life, and it's a subject that's sure to draw strong opinions.
Regardless of any controversy-inspiring debate or magazine covers, science hasn't stopped working on its end of things. Technologies have emerged and improved to extend the years in which women can get pregnant and have babies, via in-vitro, surrogacy, and egg-freezing, among other methods that are continuing to be worked on and perfected. While some argue that older parents deny their kids a certain something—running around, maybe? International adoptions at 15-year low

The number of international adoptions has fallen to its lowest point in 15 years, a steep decline attributed largely to crackdowns against baby-selling, a sputtering world economy and efforts by countries to place more children with domestic families.
Globally, the number of orphans being adopted by foreign parents dropped from a high of 45,000 in 2004 to an estimated 25,000 last year, according to annual statistics compiled by Peter Selman, an expert on international adoptions at Britain's Newcastle University.
Some adoption advocates argue the decrease is also linked to a set of strict international guidelines known as the Hague Adoption Convention. Devised to ensure transparency and child protection following a rash of baby-selling and kidnapping scandals, critics say the guidelines have also been used by leading adopting nations, including the US, as a pretext for freezing adoptions from some countries that are out of compliance.
"It should have been a real step forward, but it's been used in a way that's made it a force for shutting down" adoptions in some countries, says Elizabeth Bartholet, a Harvard law professor who promotes international adoptions. "That affects thousands of children every year."
She says places where international adoptions are stopped may ultimately see more children stuck in orphanages or on the street, where they could fall prey to sex traffickers.
US adoption officials and international agencies such as UNICEF say the Hague rules, which require countries to set up a central adoption authority and a system of checks and balances, are necessary to safeguard orphans and keep profit-driven players from corrupting a system that should be purely about helping children.
Alison Dilworth, adoptions division chief at the US Office of Children's Issues and a strong supporter of the Hague guidelines, says they shield adoptive parents from everyone's worst nightmare: "God forbid, that knock on the door ... saying your child that you have raised and loved and is fully integrated into your family was stolen from a birth parent who is desperately trying to look for them."

Couple expecting 4 children after mother, surrogate both become pregnant with twins

A Seattle couple who spent 10 years trying to conceive is now expecting four children at once, RTV6 reported.
Misty and Brian Baker had been drained financially and emotionally by in-vitro fertilization when their friends Brian and Amber Pluckebaum from Indiana stepped in to help.
Pluckebaum, who has two children of her own, agreed to be a gestational surrogate for the Bakers. Dr. William Gentry, from Indianapolis, selected the two healthiest embryos created by the Bakers to implant in Pluckebaum and implanted four lesser quality embryos in Baker.
"Why not both of you try? I mean, who knows?" Gentry told RTV6. "I think [Misty’s] thought was, 'Sure, why not? But it's not going to work with me. It never works.'"
However, both women soon learned they were pregnant with twins. Baker is carrying a boy and a girl, to be named Connor and Hope, while Pluckebaum is carrying two girls, to be named Madison and Victoria.
"There's no question that these children were loved and desired and wanted and that they have been prayed for and believed for," Baker told RTV6. "They're our little miracle babies."
The Bakers and Pluckebaums keep in contact through phone calls and Skype, according to RTV6. Early pregnancy complications prevented any travel.
Both women are due in June, but doctors expect them to deliver earlier.
